Terms & Conditions

These Terms and Conditions govern the purchase of original artwork from A.K. Papson Artworks. By purchasing any artwork, the buyer agrees to be bound by the terms set forth herein.

Original Artwork and Ownership

All works are original, one-of-a-kind creations. Upon purchase, the buyer acquires ownership of the physical artwork only. No other rights are transferred or implied.

Copyright and Intellectual Property

All artwork remains the sole and exclusive intellectual property of the artist. The artist retains all rights, title, and interest in and to the artwork, including all copyrights and related rights under applicable law.

The purchase of an artwork does not grant the buyer any rights to reproduce, distribute, display beyond personal use, digitize, license, or otherwise exploit the artwork in any form. The artist retains the unrestricted right to reproduce the artwork, create derivative works, produce prints, license the image, and use the artwork for promotional, editorial, or commercial purposes at their sole discretion.

The buyer shall not reproduce, copy, scan, photograph for distribution, digitize, mint as an NFT or other digital asset, license, or otherwise use the artwork for any commercial or non-personal purpose without the prior written consent of the artist.

The artwork may be displayed by the buyer for personal, non-commercial use only.

Commissions

Commissioned works are created based on mutually agreed-upon parameters between the artist and the client. Unless expressly agreed otherwise in writing, all intellectual property rights, including copyright and reproduction rights, remain with the artist. The client receives ownership of the physical artwork only.

Framing

Unless otherwise noted, listed artwork prices reflect the artwork unframed. Framing may be available upon request and is quoted separately. Any framing costs, timeline, and related shipping or delivery changes will be confirmed with the buyer before the artwork is released.

Payment Terms

All prices are listed in United States Dollars. Full payment is required prior to shipment or delivery unless otherwise agreed in writing.

Artwork will not be shipped, delivered, or released until all applicable artwork, shipping, delivery, framing, or related balances have been paid in full.

Shipping and Delivery

Shipping and delivery are arranged separately unless otherwise stated. Shipping and delivery costs are not included in the listed artwork price and may be invoiced separately after purchase.

The artist will contact the buyer to confirm the appropriate shipping or delivery method based on artwork size, destination, packaging needs, insurance, and delivery preferences. Artwork will not be released for shipment or delivery until all applicable shipping, delivery, framing, or related charges have been paid.

Artwork is packaged with professional care to support safe transit. Shipping timelines are estimates and may vary depending on location, carrier, artwork size, packaging requirements, framing status, and other factors outside the artist’s control.

Any nominal shipping amount displayed at checkout, including a placeholder or coordination amount, does not represent the final shipping or delivery cost unless expressly stated.

The buyer is responsible for providing accurate shipping information and for any applicable customs duties, import taxes, carrier fees, building access requirements, or related fees.

Risk of loss transfers to the buyer upon delivery.

Availability

Artwork availability is subject to change. If an artwork is purchased online but is no longer available due to prior sale, listing error, inventory error, or other unforeseen circumstance, the buyer will be notified promptly and refunded in full.

Returns and Exchanges

All original artwork sales are final. Due to the nature of original artwork, returns and exchanges are not accepted unless otherwise agreed to in writing.

If artwork arrives damaged, the buyer must notify the artist within forty-eight (48) hours of delivery and provide photographs of the artwork, packaging, and visible damage. Damage claims will be reviewed on a case-by-case basis.

Limitation of Liability

The artist shall not be liable for any damage occurring after delivery, including but not limited to damage resulting from improper handling, installation, environmental conditions, or general wear.

Color Representation

While every effort is made to accurately represent the artwork, variations in color may occur due to differences in digital displays, lighting, photography, and individual screen settings. Such variations do not constitute grounds for return or dispute.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
